Consolidated Communications Holdings, Inc. has been named in an employee’s lawsuit alleging the company owes her approximately $120,015.80 in unpaid overtime wages.

Consolidated Communications Holdings, Inc. has been named in an employee’s lawsuit alleging the company owes her approximately $120,015.80 in unpaid overtime wages. According to the complaint, the plaintiff was hired to an administrative position in 2010 by FairPoint Communications, Inc. She was allegedly paid a salary and considered exempt from overtime wages despite not being required to “execute independent judgment or discretion in her primary duties with respect to matters of significance.”
When Consolidated Communications acquired FairPoint in July 2017, the new company supposedly changed the plaintiff’s status to non-exempt based on her primary responsibilities and paid her an hourly wage. She argues, however, that despite her new classification, the defendant still refused to pay her premium time-and-a-half wages for the approximately 20 hours of overtime she worked each week.
