Boat Retailer MarineMax Facing Data Breach Lawsuit Over Allegedly ‘Foreseeable’ Cyberattack

A proposed class action lawsuit claims negligence on the part of boat retailer MarineMax resulted in a “foreseeable” data breach that reportedly compromised the personal information of approximately 123,000 current and former customers.

The 83-page MarineMax data breach lawsuit contends that the Florida-based retailer failed to protect customer information from hackers who gained access to part of the company’s computer network in an intrusion discovered on March 10, 2024. Per the case, a subsequent investigation determined that the incident exposed individuals’ full names, Social Security numbers and driver’s license numbers.
The data breach suit charges that the hack was a “direct result” of MarineMax’s failure to implement cybersecurity protocols necessary to safeguard the private information stored in its care. As the complaint tells it, the retailer maintained, used and shared the data in a “reckless manner,” making it particularly “vulnerable to cyberattacks.”
In light of the growing frequency of data breaches, the company should have understood the importance of taking reasonable cybersecurity measures, the filing argues. By storing customers’ sensitive information, MarineMax had a legal obligation to secure it against unauthorized disclosure, the privacy lawsuit asserts.
What’s more, although the defendant purports to have detected the incident in March of this year, it waited until mid-July to notify victims, the suit says.
According to the case, the notices themselves provided little detail as to the nature and dates of the breach, the identity of the perpetrators and what steps are being taken to protect stored information in the future.
“Without these details, [the plaintiff’s] and Class Members’ ability to mitigate the harms resulting from the Data Breach is severely diminished,” the complaint claims.
The MarineMax lawsuit looks to represent anyone in the United States whose private information was accessed and/or acquired by an unauthorized party as a result of the data breach reported by the defendant in July 2024.
