$8.75 Million Botanic Tonics Settlement Reached in Feel Free Kratom Lawsuit

A class action lawsuit claims Botanic Tonics and 7-Eleven have falsely marketed Feel Free Wellness Tonic as a healthy alternative to alcohol when the product contains kratom, a highly addictive opioid with harmful side effects.

An $8,750,000 settlement has been reached to resolve a proposed class action lawsuit that alleged Botanic Tonics, the maker of Feel Free Wellness Tonics, failed to warn consumers about the highly addictive nature of kratom, the products’ primary ingredient.

The Feel Free Tonic settlement, which was granted preliminary approval by the court on March 5, 2025, covers all United States residents who purchased Feel Free tonic containing kratom, including the Feel Free Classic tonic and Feel Free tonic, anytime between March 28, 2019 and March 5, 2025.
Class members who submit a valid claim form online or by mail by June 3, 2025 will be eligible to receive a pro-rated cash payment based on the number of Feel Free bottles purchased. According to the settlement website, covered individuals can claim up to 10 bottles without proof of purchase and more than 10 bottles with proof of purchase.

To file a claim form online, head to this page. You’ll be asked to enter the login and password provided in the settlement notice you should have received. If you lost or did not receive a notice, you can either request login credentials here or contact the settlement administrator.

The settlement agreement states that the defendants have also agreed to add the following disclosure to its Feel Free tonic product labels and on social media advertisements: “Warning: This product contains leaf kratom which can become habit-forming and cause serious adverse health effects. Consider avoiding this product if you have a history of substance abuse.”
A hearing is scheduled for June 26, 2025, at which the court will decide whether to grant final approval to the terms of the deal. Cash payments will be issued to eligible class members after the settlement receives the court’s final approval and any appeals are resolved.
According to the initial class action lawsuit, defendants Botanic Tonics, LLC and Hydra623 Holdings, LLC falsely advertised the Feel Free drinks as a safe, sober and healthy alternative to alcohol. Unbeknownst to consumers, the Feel Free tonics contain high concentrations of kratom—an herbal substance that carries a risk of opioid-like dependency and withdrawal symptoms, the case claimed.
