Breyers Vanilla Ice Cream Class Action Settlement

An $8.85 million settlement has been reached in a lawsuit that alleged the labeling of Breyers Natural Vanilla ice cream misled consumers to believe the product contained vanilla flavor derived only from the vanilla plant and not from non-vanilla plant sources. The class action suit alleged the Breyers vanilla ice cream, in fact, contained vanilla flavors not derived from the vanilla plant.

The vanilla ice cream settlement includes cash payouts for Breyers buyers and requires the company to reformulate the product so that it does not include vanilla from non-vanilla plant sources. 

The Breyers ice cream settlement covers consumers who bought Breyers Natural Vanilla ice cream in any size in the United States between April 21, 2016 and August 14, 2024.

The Breyers class action settlement covers Breyers Natural Vanilla ice cream in all sizes, including but not limited to the 1.5-quart (1.41L) carton, 16-oz carton, and 10 Pack of 3-oz cups, and in all packaging and labeling variations that have been used between April 21, 2016 and August 14, 2024.

Settlement class members who submit a valid claim form by the deadline are eligible for a cash payout.

Those who submit a valid claim without proof of purchase will receive $1.00 for each product up to a maximum of eight products, the website states.

While the court granted final approval to the vanilla ice cream settlement on November 21, 2024, there remains the possibility of appeals. The appeals process can take time, perhaps more than a year, the settlement website states. If you file a valid and timely claim form, you will not receive a cash payment until any appeals are resolved.

The initial Breyers ice cream lawsuit claimed that the company’s Natural Vanilla Ice Cream contained, “at most, a small amount of real vanilla” despite certain representations on the product’s labels. 

The case alleged that the defendant defied consumers’ expectations by intentionally implying that its Breyers-brand ice cream was flavored exclusively with real vanilla.
