How Did We Get Here?
The Walgreens class action lawsuit, initially filed in March 2017, claimed the pharmacy chain illegally inflated its “usual and customary” prices for prescription reimbursement, causing third-party payors (and, by extension, customers) to be charged more than those who pay for the drugs themselves. According to the case, Walgreens failed to consider the prices charged under its Prescription Savings Club discount program, which is used by most customers who do not fill their prescriptions using insurance, when determining its usual and customary prices.
The class action settlement was preliminarily approved on November 18, 2024.
