The owners and operators of The Suma Sushi are facing a proposed collective and class action lawsuit filed by former employees over alleged wage violations.
The three plaintiffs say they held various positions, including delivery worker, dishwasher, cleaner and food preparer, at the New York City restaurant without receiving proper wages in accordance with state and federal law. The case alleges the employees were paid an hourly rate that fell below the applicable minimum wage and were also deprived of proper overtime and spread-of-hours pay when they worked more than 40 hours per week or 10 hours per day.
Moreover, the suit takes issue with out-of-pocket business expenses supposedly incurred by the plaintiffs, who claim they were each required to spend approximately $1,500 on electric bicycles needed to make food deliveries. Citing U.S. Department of Labor regulations, the case argues these costs should have been reimbursed because it’s the employer’s responsibility to “provide tools of the trade which will be used in or are specifically required for the performance of the employer’s particular work.”
