Mejia Mendez et al v. Sweet Sam's Baking Company Llc et al
Filed: October 26, 2018 ◆§ 1:18cv9910
Sweet Sam's Baking Company are facing a proposed collective action over claims that it failed to pay employees for all time worked.
New York
Sweet Sam’s Baking Company LLC and two individuals with control of the business find themselves as defendants in a proposed collective action that claims one former and one current employee were not paid for all hours worked.
According to the lawsuit, the plaintiffs regularly put in over 40 hours each week for an hourly wage but failed to receive compensation for time worked beyond their scheduled hours. Specifically, the plaintiffs claim they had to work one or two hours beyond each scheduled shift without additional pay. Although the workers were required to keep track of their time, the case alleges the defendants avoided paying overtime wages by directing employees to record fewer hours than they actually worked.
