A lawsuit has been filed against SCO Family of Services, Inc. in which a former employee claims she was not paid proper wages for her overtime work.

A proposed collective action has been filed against SCO Family of Services, Inc. in which a former employee claims she was not paid proper time-and-a-half wages for her overtime work.
The suit says the plaintiff was employed as a full-time nurse for the defendant, a company that provides social services to “elderly, ill and/or frail” individuals in the New York City area. The case alleges the defendant failed to include a May 2016 retroactive lump sum when calculating the plaintiff’s time-and-a-half rate, which resulted in her being underpaid for her overtime hours.
“For example, during the weeks of 4/24/16-4/30/16 and 5/1/16-5/7/16, Plaintiff worked Monday through Friday 8:00 am to 6:00 pm and Saturday 1:00 am to 5:00 pm, for approximately 49 hours each of those weeks. Defendant paid Plaintiff and the Collective overtime wages for each of those weeks, but failed to include in its overtime calculation the lump sum retroactive pay that Plaintiff and the others received,” the lawsuit says.
