Sagar Chinese Eateries Accused of Wage Abuses in Ex-Server’s Lawsuit

The operators of two Sagar Chinese restaurants in New York are facing a lawsuit filed by an ex-employee who claims he was deprived of appropriate wages.

The operators of two Sagar Chinese restaurants in New York are on the receiving end of a lawsuit filed by an ex-employee who claims he was deprived of appropriate minimum, overtime and spread-of-hours wages.
Throughout his tenure as a server at the restaurants, the plaintiff alleges he worked a least 66 hours each week for an hourly rate between $3 and $5 plus about $15 to $30 in tips each day. The man claims that while he was ostensibly hired as a tipped server, he was required to spend two to three hours per shift performing non-tipped duties such as cleaning and wiping floors. The suit thereby claims that the man should have been paid at least the regular minimum wage and argues that he didn’t even receive the tip-credited rate allowed by law for food service workers.
The man further charges that he was not paid for roughly 60 hours put in during his first week of work, which the lawsuit says the defendants claimed was a training period for which the man was not entitled to compensation.
Lastly, the case says the plaintiff was required to take part in an unlawful tip pool in which the restaurants’ manager misappropriated half of all contributions.
