Roofers Claim Marfi Contracting Corp. Failed to Pay Appropriate Wages

The owners and operators of construction company Marfi Contracting Corp. find themselves as defendants in a lawsuit filed over unpaid wage allegations.

The owners and operators of construction company Marfi Contracting Corp. find themselves as defendants in a proposed collective action filed in New York over unpaid wage allegations.
The plaintiffs behind the lawsuit were employed as roofers and worked on publicly funded state projects for the defendants. According to the case, the defendants failed to pay the men state-mandated prevailing wages as set forth in the contracts between the construction company and public entities. From the complaint:
“Depending on the particular contract and the type of work performed, the prevailing regular rate of wages on work performed for the Defendants ranged from approximately $40.70 to $49.00 an hour, depending on the locality and contract. For work performed on weekends, the prevailing wage amounted to time and a half or in some cases double time, for work performed on weekends, and, in some counties, call for an additional amount of money on top of the half time premium.”
The case alleges the plaintiffs regularly worked in excess of 40 hours per week without receiving appropriate prevailing wages or time-and-a-half overtime pay.
Moreover, the suit charges the defendants failed to issue the workers wage notices and accurate paystubs, a violation of state labor law. One plaintiff further claims he was required to pay out-of-pocket for construction tools, such as a knife, hammer and measuring tape, without being reimbursed.
