Behind the lawsuit is an individual who was employed as a busboy and delivery worker at the eatery. The man alleges he put in between 60 and 72 hours each week for a fixed weekly salary of $240. Although the man was ostensibly employed as a tipped worker, the suit says, he spent a significant part of each workday—over 20 percent—cleaning the restaurant, preparing food and handling other non-tipped duties. Moreover, the case claims that the plaintiff was never properly notified of his reduced pay rate and that the defendants withheld the man’s tips. As such, the plaintiff should have been paid at least the full minimum wage, the suit argues.
The complaint further charges that the man was deprived of proper overtime and spread-of-hours wages. Lastly, the suit says the defendants failed to maintain any time-keeping practices and failed to issue the plaintiff accurate paystubs throughout his tenure.
