Two former employees of New York City bistro Jack’s Wife Freda claim that they were not paid for all hours worked and did not receive lawful overtime wages.
Two former employees of New York City bistro Jack’s Wife Freda claim in a proposed collective action that they were not paid for all hours worked and did not receive lawful overtime wages.
The case names as defendants Molly Picon LLC and the company’s two owners, who operate two eateries in the city. The suit says the plaintiffs respectively put in at least 51 and 60 hours each week in the roles of dishwasher, cleaner, kitchen worker, cook and food preparer. According to the case, the men received flat weekly rates that did not cover overtime work that should have been paid at the proper time-and-a-half rate. One plaintiff further claims he received no wages at all for his first and last weeks on the job.
The complaint goes on to allege the defendants did not maintain proper payroll records and failed to issue the workers wage notices and paystubs, a violation of New York law.
“Defendants’ unlawful conduct has been widespread, repeated, and consistent,” the complaint charges.
