A former Nisen Sushi teriyaki chef claims he was not paid proper overtime or spread-of-hours wages.

Nisen Sushi and the restaurant’s two owners are the defendants in a lawsuit filed by a former teriyaki chef who claims he was not paid proper overtime or spread-of-hours wages.
The man regularly clocked between 50.5 and 58 hours at the Commack, New York eatery for a weekly rate of $650 to $700, according to the case. Citing the Fair Labor Standards Act (FLSA), the suit claims that this fixed salary failed to meet the law’s time-and-a-half wage requirement for hours worked in excess of 40 each week.
Lastly, the plaintiff adds that he was required to log fewer hours than he actually worked, which resulted in inaccurate wage statements.
