A former stocker and sandwich preparer has filed suit against the operators of Devoe Grocery Store over claims that he was deprived of appropriate minimum, overtime and spread-of-hours wages.

A former stocker and sandwich preparer has filed suit against the operators of Devoe Grocery Store over claims that he was deprived of appropriate minimum, overtime and spread-of-hours wages.
According to the proposed collective action, the plaintiff typically clocked about 55 to 65 or more hours each week at the Bronx supermarket for a fixed weekly salary between $250 and $300, resulting in an hourly rate that the man claims fell below the lawful minimum wage. This salary did not vary even when the man was required to work beyond the end of his shift, the suit alleges, adding that the plaintiff was usually required to stay 10 minutes past his scheduled departure time for no additional pay.
Lastly, the plaintiff claims his wages were further reduced due to the fact that he had to purchase supplies with his own funds, including cleaning wipes, rat poison, sponges and plumbing sealant.
