Lawsuit Alleges Blacktop Companies Underreported Laborers’ Overtime Hours

Quality Blacktop Services and Steven Hellerman Driveway Corp. face a lawsuit filed over allegedly improper wage practices.

Quality Blacktop Services, Inc. and Steven Hellerman Driveway Corp. are among the defendants in a lawsuit filed by three former employees who allege the companies falsified overtime records in an effort to avoid paying proper wages.
The plaintiffs, who worked as laborers for the defendants, claim they routinely worked from 6:30 a.m. until 5:00 p.m. or later six days per week. According to the suit, the plaintiffs were paid time-and-a-half overtime for some of their hours worked over 40 each week, yet the defendants supposedly engaged in the practice of falsely reporting the individuals’ hourly pay rates to lower the amounts of overtime wages they were owed. Remaining overtime hours were unlawfully paid at the workers’ regular rates of pay, the case claims.
Adding to these wage and hour claims, the case later alleges the defendants failed to pay the plaintiffs prevailing wages despite New York state’s requirements that such be paid for certain public works projects.
