Americare Home Solutions LLC is facing a proposed class and collective action that alleges the company attempts to avoid paying employees premium overtime wages by reducing their hourly pay rates during weeks in which they work more than 40 hours.

“For example,” the complaint attests, “during weeks in which Plaintiff does not work overtime, Defendant pays her $10.00/hour. But, during weeks in which Plaintiff works over 40 hours, Defendant pays her only $9.00/hour.”
The suit argues that caregivers, home health aides, and other hourly employees who work for the defendants’ home care services business should have received 150 percent of their “regular rate of pay” for each overtime hour instead of a reduced rate.
