A proposed collective action out of New York federal court accuses JC Tree Care NY Corp. and the company’s two owners of federal and state wage violations.
The plaintiff regularly put in 74 hours each week as a driver and laborer at the company from May to September 2018, the suit says. During his tenure, the plaintiff says he received a fixed daily rate of between $160 and $175, which the case alleges failed to include time-and-a-half pay for overtime work.
Additionally, the suit claims the employers violated state law when they “refused” to give the worker accurate paystubs, a wage notice, and proper meal breaks.
