The owners and operators of BBC Deli & Grocery find themselves on the receiving end of a proposed collective action filed by a former cook over alleged wage infractions.
According to the complaint, the plaintiff worked at the Bronx deli from September 2015 to October 2018 and received a fixed weekly salary that increased from $450 to $600 by the end of his tenure. The man claims he typically clocked 63 hours each week and was required to work 30 minutes past his scheduled departure time two days per week for no additional pay. These pay practices, the suit charges, robbed the cook of proper minimum, overtime and spread-of-hours wages.
