The operators of the Mayflower Hotel and Wyndham Garden join three managers as defendants in a lawsuit alleging wage and hour infractions.
The operating companies of the Mayflower Hotel and Wyndham Garden join three managers as defendants in a proposed collective and class action alleging wage and hour infractions.
According to the case, the plaintiff was employed as a construction worker and later as a chef at the Mayflower Hotel in Fresh Meadows, New York from September 2016 through August 2018. Throughout his tenure, the suit alleges, the defendants failed to pay the man proper overtime and spread-of-hours wages even though he generally worked well in excess of 40 hours per week and sometimes worked more than 10 hours per day. In addition, the plaintiff says he wasn’t paid for all hours worked or granted uninterrupted meal breaks when he worked as a chef.
Lastly, the suit claims the defendants failed to keep “full and accurate” payroll records, issue wage statements and notify the plaintiff of any tip credit that may have been applied to his pay rate.
