Construction Worker Claims Employers Owe Him ‘Several Months’ of Unpaid Wages

Adam Builder Corp. (which does business as Adam Construction Co.) and two individuals with control of the business have been named as defendants in a proposed collective action filed by a former employee who claims he was not paid his due wages.

Adam Builder Corp. (which does business as Adam Construction Co.) and two individuals with control of the business have been named as defendants in a proposed collective action filed by a former employee who claims he was not paid his due wages. The plaintiff allegedly worked for the defendants as a construction worker between September 2016 and September 2017, putting in an average of 60 hours of work per week. Though his employers supposedly promised to pay him $120.00 per eight-hour shift, the man says he was paid “miscellaneous amounts” that fell below the minimum wage and failed to include premium overtime and spread-of-hours wages. The suit further argues that the plaintiff was paid “at random intervals” and didn’t receive any wages at all for “several months” of his employment.
On top of that, the case alleges, two of the man’s paychecks bounced due to insufficient funds, causing him to incur extra fees from his bank that were never reimbursed to him.
The complaint also claims the defendants failed to provide employees with proper wage notices and statements as required under state law.
