Cision Failed to Pay Sales Reps Proper Overtime Wages, Lawsuit Alleges

Cision faces a lawsuit that claims the public relations software and services provider failed to pay sales representatives proper overtime wages.

Cision US Inc. and Cision Ltd. face a proposed class and collective action that claims the public relations software and services provider failed to pay sales representatives proper overtime wages.
Although the workers regularly put in more than 40 hours per week, it was Cision’s policy, according to the suit, to deprive them of lawfully earned time-and-a-half overtime pay. The lawsuit alleges violations of the Fair Labor Standards Act as well as New York, Illinois and Maryland labor laws.
The case says Cision’s sales employees, tasked with selling Cision’s products and services, including Bulletin Intelligence, PR Newswire and Falcon.io, worked in the following positions:
Sales reps, according to the case, performed non-exempt sales-related tasks, including communicating with clients and potential clients, researching leads, booking meetings with clients and potential clients and making sales. Though the workers consistently put in more than 40 hours per week, Cision failed to record their overtime hours and pay them accordingly, the suit alleges.
The lawsuit argues that Cision’s refusal to pay sales reps proper overtime wages was “willful” and a matter of policy.
“Upon information and belief, Cision’s unlawful conduct has been pursuant to a corporate policy or practice of minimizing labor costs by violating the FLSA and state wage and hour laws,” the suit alleges.
