Marte Construction is facing a lawsuit filed by three formerly employed carpenters who allege they were not paid properly for overtime work.

Marte Construction Inc. and the contracting company’s owner are staring down a proposed collective action filed by three formerly employed carpenters who allege they were not paid properly for overtime work.
According to the case, the plaintiffs worked 60 hours each week at various work sites in New York City for a fixed daily rate that failed to provide proper overtime compensation. The suit argues that the plaintiffs were non-exempt employees entitled to time-and-a-half overtime pay as the defendant controlled most aspects of their jobs, including work standards, rates of pay and schedules.
