The operators of Alphonso’s Pizzeria Trattoria are on the receiving end of a proposed collective action wherein a former employee alleges he was deprived of proper minimum, overtime and spread-of-hours wages.
The plaintiff claims that while he was ostensibly employed as a tipped delivery worker at the New York eatery, he spent a significant portion of each shift—over 20 percent—cleaning, cooking, taking phone orders and working the register, among other non-tipped tasks. As such, the case argues the defendants were not entitled to take a tip credit against the man’s hourly pay. Lastly, the suit adds that the plaintiff, who typically put in 73 hours per week, supposedly did not receive approximately $2,000 in wages.
