An Arkansas woman has filed suit against joint employers National Park Motors, Inc.; Orr Motors of Fort Smith 4, Inc.; Orr Motors of Fort Smith 3, Inc.; Orr Motors of Russellville, Inc.; and Orr, Inc. claiming they owe her unpaid overtime wages.

An Arkansas woman has filed suit against joint employers National Park Motors, Inc.; Orr Motors of Fort Smith 4, Inc.; Orr Motors of Fort Smith 3, Inc.; Orr Motors of Russellville, Inc.; and Orr, Inc. claiming they owe her unpaid overtime wages. The plaintiff says she worked for the defendants as a title clerk between December 2015 and November 2017 and was primarily responsible for processing sale paperwork and keeping track of the used vehicles in stock. According to the complaint, the defendants misclassified her as exempt from receiving overtime wages and paid her a salary instead of providing her an hourly time-and-a-half premium for hours she worked above 40 each week. She claims she did not have the authority to hire and fire other employees and that her job did not require “any professional education,” meaning she should have been considered a non-exempt employee.
