Payroll solutions company ADP finds itself facing a proposed collective and class action filed by a former customer service representative who claims he was not paid for between 10 and 30 minutes of pre-shift tasks each workday.
Filed in New Jersey, the lawsuit says the man was required to arrive at the defendant’s call center early in order to complete pre-shift duties without pay, including booting up his computer and logging into applications. ADP deprived the plaintiff of proper minimum and overtime wages by prohibiting him from clocking in until after completing this daily boot-up procedure, the case alleges. The suit argues the man should have been paid for these pre-shift activities as they were “integral and indispensable” to his job and the company’s business.
