A proposed collective action claims that A&G Gates Rolling Doors and the company’s owner failed to pay a former employee proper wages.
A proposed collective action out of New York federal court claims that A&G Gates Rolling Doors and the company’s owner failed to pay a former employee proper wages.
According to the case, the plaintiff put in 50 hours each week as an “iron worker” for the Bronx-based gate production business from March to September 2018. The man was allegedly paid a fixed rate of $700 for his first week at the job, after which he was asked to bring in his work permit and Social Security number in order for the defendants to “process his payroll and deduct the corresponding taxes” from his salary. From that point on, the suit says the man received $450 per week in cash.
The plaintiff went on to inquire about his unpaid overtime work and request a detailed paystub because “$250.00 in taxes seemed excessive,” the case says. The complaint describes the defendants’ response as follows:
“Defendants gave a series of different excuses and Plaintiff continued to work. However, Plaintiff continuously requested paystubs and compensation for his overtime work. By September 29, 2018, Defendant became agitated by Plaintiff’s requests and terminated Plaintiff’s employment.”
