What Was the Panera Class Action Lawsuit About?
The Panera Bread class action lawsuit—one of three to be consolidated—alleged that the fast-casual restaurant chain, despite advertising that consumers would pay only a flat, low-cost delivery fee during the COVID-19 pandemic, quietly added hidden charges onto delivery orders that caused a significant increase in food prices.
The suit claimed that consumers placing an order for delivery were misled to believe that Panera would charge them only the advertised $4 delivery fee. Per the case, customers were unaware that the restaurant would secretly add an extra five- to 10-percent markup on their delivery orders.
The class action lawsuit argued that the alleged deception meant that many consumers made food purchases from Panera that they otherwise would not have made.
