Ynigo Landscaping and Lawn Services, Inc. and an individual owner are facing a proposed collective action filed by a former employee who claims he was not paid proper overtime wages and fired in retaliation for complaining about his pay.

Ynigo Landscaping and Lawn Services, Inc. and an individual owner are facing a proposed collective action filed by a former employee who claims he was not paid proper overtime wages and was fired in retaliation for complaining about his pay. The plaintiff says he worked 70 hours per week on average and received $95 per day as compensation. According to the suit, the defendants should have paid him time-and-a-half overtime wages for all the hours he worked above 40 each week.
When the plaintiff voiced his concerns over the defendants’ pay practices – which the complaint notes is a protected activity under the Fair Labor Standards Act (FLSA) – he was allegedly terminated in retaliation. According to the suit, “There was no reason other than a retaliatory action to terminate [the plaintiff’s] employment with [the defendant].”
