West Memphis Fence & Construction, Inc. is staring down a proposed collective action that accuses the company of misclassifying its laborers as exempt from overtime wages.
The suit was filed by a fence installer who says he regularly put in over 50 hours each week without any compensation for overtime work. The case argues putative class members were “classic blue-collar workers” with no control over the defendant’s business or their work conditions, meaning they should have been designated as non-exempt employees in payroll records.
