Two plaintiffs say they were routinely required by Creek Oilfield Services to work off the clock without overtime pay.
North Dakota’s Creek Oilfield Services, LLC is the defendant in a lawsuit in which the plaintiffs claim they and similarly situated current and former employees are owed unpaid overtime wages. The plaintiffs—one of whom worked for the defendant from June through August 2017, while the other is still employed by Creek—allege they were routinely required to work off the clock without time-and-a-half overtime pay for all hours worked past 40 each workweek. This off-the-clock work, the case says, included time spent in daily safety meetings, loading and unloading equipment, and transporting workers to and from job sites. The plaintiffs charge they work/worked an average of five to 10 off-the-clock hours per week without compensation. Moreover, the men claim management for the defendant knew employees were working off the clock without proper pay, an apparent willful violation of the Fair Labor Standards Act (FLSA).
