Two former employees have filed suit against F. J. O’Hara & Sons Inc. and an individual owner of the business claiming they are owed unpaid overtime wages and were fired in retaliation for complaining about the defendants’ pay practices.
Two former employees have filed suit against F. J. O’Hara & Sons Inc. and an individual owner of the business claiming they are owed unpaid overtime wages and were fired in retaliation for complaining about the defendants’ pay practices. The plaintiffs say they were employed as warehouse workers for the defendants’ cold storage/warehouse/distribution company and regularly worked more than 40 hours per week without receiving premium wages for the hours they worked over 40.
According to the complaint, the first plaintiff was paid $10.00 cash per hour “without any paystub providing basic information about total number of hours worked, overtime hours, wage rate, employment taxes withheld etc. [sic].” The second plaintiff says he was paid a bi-weekly salary of $650.00 for the first 50 hours of work, but was not compensated at all for the hours he worked beyond 50.
The suit alleges that both plaintiffs complained to management concerning the lack of overtime pay and were unlawfully terminated in retaliation.
