A proposed collective action has been filed against Schneider Electric USA, Inc. claiming the company failed to pay its warehouse associates proper overtime wages. The plaintiffs in the case – one former and one current employee – say their primary duty was to use a forklift to “pick” items from the warehouse to fill orders, which required them to work more than 40 hours per week. The suit argues that although they should have been paid a time-and-a-half premium rate for the hours they worked over 40, the defendant refused to compensate warehouse workers according to Fair Labor Standards Act overtime requirements.
