A proposed collective and class action has been filed against The Golden 1 Credit Union over claims of unpaid overtime wages and meal and rest break infractions.
A proposed collective and class action has been filed against The Golden 1 Credit Union, Inc. over claims of unpaid overtime wages and meal and rest break infractions.
The plaintiff worked for the financial services company as a customer support representative out of a Sacramento call center, the lawsuit says. According to the case, the man performed “substantial off-the-clock work every day,” including booting up his computer and logging in and out of applications, that resulted in four to 10 minutes of unpaid work each day.
The lawsuit further alleges the defendant failed to pay proper overtime wages because it neglected to count non-discretionary bonuses as part of the plaintiff’s regular rate of pay when calculating his overtime rate.
The case goes on to claim the company “encouraged or required” the plaintiff and similarly situated workers to skip their rest periods. From the complaint:
“More specifically, Defendant required CSRs [customer service representatives] to return to their work stations early from their lunch break to complete the log-in process, so they were prepared to resume taking calls immediately after their lunch break ended. Additionally, during rest break, Defendant failed to completely relieve the CSRs from their work duties.”
