A proposed collective action has been filed against New Jade Fountain Enterprises Corp., I Chopstick Chinese Restaurant, Inc., and two individuals over potential labor law violations.
A proposed collective action has been filed against New Jade Fountain Enterprises Corp., I Chopstick Chinese Restaurant, Inc., and two individuals over potential labor law violations. The plaintiffs in the case claim they worked at the defendants’ Chinese restaurant as a waiter and helper/dishwasher, respectively, without being paid properly.
The plaintiffs allege that they received a fixed monthly salary that never varied even when they worked more hours than scheduled. According to the complaint, the workers regularly put in more than 40 hours per week and 10 hours per day but weren’t paid overtime or spread-of-hours wages in accordance with federal and state law. On top of that, the plaintiffs claim that the defendants didn’t provide them with bona fide meal breaks, nor accurate wage statements.
