China Garden of 88 Inc. (which does business as China Garden) and two individual owners are on the receiving end of a proposed collective action filed by a former cook who claims he wasn’t paid proper wages.
China Garden of 88 Inc. (which does business as China Garden) and two individual owners are on the receiving end of a proposed collective action filed by a former cook who claims he wasn’t paid proper wages. According to the complaint, the man worked at the defendants’ restaurant for approximately 73 hours per week between May and August 2015. Despite the long hours, the plaintiff says he was never paid premium overtime or spread-of-hours wages in accordance with state and federal law and instead received a flat $3,000.00 monthly rate in cash. The case also argues that the defendants never provided the plaintiff with uninterrupted meal breaks, accurate paystubs, or wage notices.
