A former employee claims she worked anywhere between 36 and 79 hours per week without proper wages, sometimes without wages at all.
The company that operates as Fresh Value Market in Rego Park, New York is on the receiving end of a proposed collective and class action filed by a former employee who claims she’s owed unpaid minimum, overtime and spread-of-hours wages. The complaint states the plaintiff was employed as a cashier by defendant 63 Super Mart Inc. from December 2017 through January 1, 2018 and did not get any additional premium when working more than 40 hours per week. The plaintiff claims, for instance, she worked at least 79.25 hours during the weekly pay period ending on December 31, 2017, for $9 per hour without time-and-a-half pay for each hour worked past 40. Further, the case claims the plaintiff was paid no wages at all for work done on December 5 and 6. All told, the lawsuit alleges the plaintiff worked between 36-79 hours per week, and sometimes seven days per week, without appropriate wages.
