Twenty-four companies and six individuals that operate Fay Da Bakery locations across three states are the defendants in a proposed class and collective action wherein four plaintiffs allege employees were not paid proper wages. The plaintiffs claim Fay Da Bakery has violated the minimum and overtime wage provisions of the Fair Labor Standards Act, as well as New Jersey, New York, and Connecticut labor laws, by taking illegal meal break deductions, called “meal credits,” from workers’ pay regardless of whether such breaks were taken.
“Such meal deduction was automatic,” the lawsuit states, “and was taken by Fay Da Bakery for each work day which Fay Da employees, bakers as well as cashiers, reported to work.”
The plaintiffs further allege the defendants unlawfully failed to reimburse workers for time and costs relating to the laundering of work uniforms, which the lawsuit says require roughly 45 minutes to launder and 30 minutes to dry, or about one hour and 15 minutes of care each day.
