A proposed collective action has been filed against Villa Berulia Inc. and five individual owners by a former cook who claims he is owed unpaid overtime wages.
A proposed collective action has been filed against Villa Berulia Inc. and five individual owners by a former cook who worked at the defendants’ Italian restaurant between July 2014 and February 2018. The man claims he consistently worked more than 40 hours per week without being paid time-and-a-half wages for the hours he worked over 40. The case alleges that throughout his employment, the plaintiff’s fixed weekly salary ranged between $831.00 and $1,181.00, depending on his schedule, but never included overtime pay. On top of that, the lawsuit attests, the plaintiff would sometimes work 20 minutes past the end of his shift without being paid for the additional time.
The suit further accuses the defendants of failing to provide employees with proper wage notices and statements in violation of state law.
