Midway Industries, Inc., Tool Steel Service, Inc., and Tool Steel Service of California, Inc. are the defendants in proposed collective and class action that claims the plaintiff was not paid for his overtime work at the proper time-and-a-half rate.
According to the suit, the plaintiff worked at the defendants’ Arkansas location and was responsible for duties pertaining to the sale and transportation of the companies’ steel products. The case claims the defendants had an unlawful policy of giving employees “comp” time for overtime work at their straight rates of pay rather than paying out time-and-a-half wages.
