La Casa De Los Trucos and the Miami costume shop's two owners are facing a lawsuit filed by an ex-employee who claims he was deprived of proper overtime pay.
La Casa De Los Trucos, Inc. and the company’s two owners are on the receiving end of a former employee’s proposed collective action in which the man claims he was not paid at a proper overtime rate.
The plaintiff worked as a salesperson at the Miami costume shop from August 2015 to November 2018. The suit says the man put in an average of 48 hours each week, with the exception of the shop’s “busy season” between September and October in which he clocked 70 hours per week. Throughout his tenure, the case alleges, the plaintiff was paid $8.25 for regular and overtime hours worked, resulting in an effective pay rate that fell below the minimum wage.
