Two former employees of Babbalucci Italian Kitchen claim in a proposed collective action that they were deprived of overtime pay in violation of federal and state labor laws.
The plaintiffs claim to have worked at least 63 hours each week for the New York City restaurant and its three individual owners, for which they were compensated with fixed weekly salaries that allegedly failed to pay the men for overtime hours worked. Moreover, the suit continues, the plaintiffs claim they did not receive proper wage notices or any wage statements throughout their tenures, in violation of New York law.
