Kidd, et al. v. Lowe’s Home Centers, LLC, et al.
Filed: April 17, 2019 ◆§ 1:19-cv-00245-HSO-JCG
The corporate operators of Lowe’s Home Improvement stores face a collective action filed by salaried employees who claim they are owed unpaid overtime wages.
Mississippi
The corporate operators of Lowe’s Home Improvement stores find themselves as defendants in a collective action filed by salaried employees who claim they are owed unpaid overtime wages.
Filed by three project specialists in Mississippi, the lawsuit says the plaintiffs worked a “corporate schedule” of 48 to 60 hours per week for fixed salaries. The case argues that although the plaintiffs were classified as exempt from overtime, their job duties more accurately reflected those of non-exempt employees and their salaries were ultimately based on a 40-hour workweek. This indicates that the employees should have received time-and-a-half overtime wages on top of their regular pay, the lawsuit states.
