The operating company and individual owner of Sidecar Bar & Grille are facing a wage and hour lawsuit filed by a former employee who says he worked at the New York restaurant as a cook and food preparer. The plaintiff alleges that the defendants scheduled him to work between 45 and 54 hours per week without paying him appropriate time-and-a-half overtime wages or spread-of-hours pay. In fact, the complaint argues, the plaintiff was either paid at his straight-time hourly rate for all hours worked or was paid a fixed weekly salary that didn’t change even when he worked extra hours. He further claims his paychecks were “greatly reduced” and didn’t accurately reflect how much he had worked each week.
