A lawsuit claims the operators of homecare franchise Always Best Care Senior Services failed to pay overtime wages to a former employee.
A proposed collective action out of Tennessee federal court claims the operators of homecare franchise Always Best Care Senior Services failed to pay overtime wages to a former employee.
The plaintiff regularly worked as a caregiver for more than 40 hours each week between January 2017 and January 2018, the suit says. The woman alleges she was paid “a day rate or flat rate” for all her hours worked, including overtime hours that should have been paid at a time-and-a-half rate.
“Defendants received complaints from Plaintiff or Class Members regarding these excessive hours and the failure to compensate for all hours worked but failed to redress these concerns, necessitating this lawsuit,” the case notes.
