Statewide Harvesting & Hauling, LLC is on the receiving end of a proposed collective action filed by a former employee who claims the defendant failed to pay him proper overtime wages. The plaintiff says he worked for the company as a supervisor and was responsible for driving workers to farms, to their dormitories, and on personal errands – which, the suit says, were “in no way related to agriculture.” According to the complaint, supervisors like the plaintiff worked an average of 60 hours per week without receiving time-and-a-half overtime wages for the hours they worked above 40. They were allegedly paid “in relation to the amount of fruit collected from the farm” and were not compensated for the time they spent driving workers to places other than the farms.
