The owners and operators of New Jersey’s Clinton Car Wash and Royal Touch Hand Car Wash are staring down a proposed class and collective action that alleges workers were not paid required overtime wages. Filed against Clinton Car Wash Associates, LLC, Royal Touch Hand Wash, LLC, 45 West Clinton Associates, L.L.C. and two individuals, the case says the plaintiff and similarly situated workers regularly worked at least 10 hours per day, seven days per week, without being paid New Jersey’s minimum wage. According to the plaintiff, workers’ weekly cash payments amounted to $8 or less per hour for all hours worked.
Moreover, the lawsuit alleges the defendants never provided the plaintiff and proposed class members with mandatory notice that a tip credit would be taken on their wages.
