Johnston et al v. Titan Logistics & Resources, Llc et al
Filed: December 14, 2017 ◆§ 2:17cv1617
According to 24 plaintiffs, Titan Logistics & Resources and Beemac Trucking failed to honor agreements concerning truck drivers' wages and reimbursements.
Pennsylvania
Twenty-four plaintiffs have put their names on a lawsuit against Titan Logistics & Resources, LLC, Beemac Trucking, and one individual to recover allegedly unpaid wages. The case notes the plaintiffs were employed by Titan Logistics & Resources and the individual defendant until the parties sold their business contracts and transferred personnel to Beemac Trucking.
The plaintiffs allege they “normally worked seven days each week”—frequently in excess of 60 hours per week—with few days off during their employment. The individuals claim the defendants agreed to pay truck drivers a day rate of approximately $350 plus a $25 per diem and reimbursement for business expenses, such as lodging and fuel costs. According to the complaint, the defendants, including successor-in-interest Beemac, did not fulfill their end of the bargain.
“Despite [the plaintiffs] performing as agreed upon [Titan and the individual defendant] have failed to pay [the plaintiffs] the day rate, per diem, or expense reimbursement promised,” the lawsuit reads. “Put simply, [the plaintiffs] have worked for [the defendants] for nothing—no pay, no reimbursement of expenses—for one or more workweeks in the relevant period.”
The case goes on to claim the plaintiffs were told by the defendants that they were exempt from overtime pay, and have lost money as a result of the defendants’ alleged wage and hour failings. All told, the complaint asserts the defendants owe proposed class members $1,000,000 or more.
