A proposed class action claims defendants Trojan Labor and Complete Development, Inc. failed to pay hourly workers proper overtime wages in accordance with the Fair Labor Standards Act (FLSA). The lawsuit seeks the recovery of allegedly unpaid wages, as well as relief related to the defendants’ alleged termination of the plaintiff in retaliation for his objections to supposedly not being paid for all hours worked.

The plaintiff, more specifically, claims he was not paid for time spent traveling between job sites. Moreover, the defendants allegedly withheld approximately three to five hours of wages from the plaintiff from his last day of work. From the case: 

“[The plaintiff] complained of payroll irregularities and for specifically not being paid all the hours [he] worked. [The defendants] advised [the plaintiff], in response to [the plaintiff’s] lawful request for wages, ‘you can either be paid for those hours and fired or you can let it (the unpaid hours) go.’ [The plaintiff] still has not been paid for the hours that he worked without compensation. [The defendants] have not paid [the plaintiff] for all the hours he worked. [The defendants have] advised [the plaintiff] that [he] is terminated, because [the plaintiff] made the above reference request for wages.”
