Tri-State Candy Wholesale, Inc., United Beverage Distributor Inc. (which does business as Beer Brothers), and two individuals have been named as defendants in a proposed collective action that claims they violated several labor laws.

Tri-State Candy Wholesale, Inc., United Beverage Distributor Inc. (which does business as Beer Brothers), and two individuals have been named as defendants in a proposed collective action that claims they violated several provisions of the Fair Labor Standards Act and New York state law. The plaintiff – who was employed by the defendants as a driver, truck loader, and stocker – says he worked more than 40 hours per week without receiving proper overtime wages for the hours he worked above 40. He further claims he is owed extra pay for each shift that lasted longer than 10 hours, as required by state law.
Additionally, the defendants allegedly failed to provide employees with accurate wage notices and weekly statements that detailed their hours and pay rates.
