Tremont Towing, Inc. and three individuals with control over the business are the defendants in a proposed collective action in which the plaintiff claims he’s owed unpaid wages. According to the complaint, the plaintiff, a tow truck driver employed by the defendants from March 2016 through March 2018, was not paid proper time-and-a-half overtime or minimum wages during any workweek within the last three years. Moreover, the case claims the defendants improperly withheld portions of the plaintiff’s pay, an apparent Fair Labor Standards Act (FLSA) violation.
The lawsuit says the plaintiff routinely put in 55 hours per week without appropriate wages.
